Will I need an atorney?

Yes you will.  However, if you let your attorney know up front that you plan on resolving your divorce via mediation and simply require your attorney to prepare the filings, your legal fees should be low. 

If you have not yet retained an attorney we have several we can recommend.  

What if there are minor children involved?

The most challenging issue in most divorces is the parenting plan.  Mediation provides the most effective way to develop a parenting plan that meets the needs of both parties and is acceptable to the Court.

How long does mediation take?

The mediation itself can generally be completed in 4-6 hours depending upon the participation of the parties and their willingness to reach an agreement.  The time involved is also dependent upon the complexity and volume of the issues involved.

 

My spouse and I can't discuss these issues without fighting.  How are we ever going to be able to mediate?

This is a common problem in divorce and is readily accomodated by the mediation process.  The mediator will place each party in separate rooms and work with each party separaely to reach an agreement.  This is called caucusing and the mediator will shuttle between the rooms to discuss solutions.

How much does mediation cost?

The fee for mediation is $200 per hour with a minimum fee $800 and must be paid prior to the mediation session begins.  We accept credit cards, cash, money orders, and checks from law firm accounts.  Personal or business checks may be accepted with prior arrangement.

What if we can't reach an agreement?

First of all most divorces that go to mediation result in an agreement on at least some of the issues if not all.  However, if you are unable to reach an agreement on all of the issues then the dispute continues through the litigation process.

Often cases will return to mediation if they are unable to reach a full agreement in the first session.  the Court may direct the parties to return to mediation or the parties may decide to return voluntarily.
